Menstrual Leave Implemented Locally in France

While there is currently no specific legislation regarding menstrual leave in France, the topic gained significant attention this year after environmentalist deputies submitted a law proposal advocating the implementation of menstrual leave nationwide. Pending the examination of this proposal, various private and public institutions have taken the initiative to implement menstrual leave policies at the local level.

In December, news outlets reported that the menstruating staff at Arras town hall (in northern France) and menstruating students of the University of Angers (in western France) now have the option to request time off during their menstrual periods.

At Arras town hall, employees seeking to take a menstrual leave are required to first consult with a doctor. If their leave request is approved, the time taken off work will be fully compensated with no deduction of pay, starting from the first day of absence.

At the University of Angers, each menstruating student is now entitled to take up to one day off per month or a total of ten days off throughout the academic year to recuperate at home during their menstrual periods, or seek necessary medical care.

The proliferation of local initiatives in support of menstrual leave, coupled with the generally favorable responses these initiatives have received, may well influence the forthcoming deliberations in the French National Assembly regarding the abovementioned legislative proposal, titled "Regarding the Recognition of Menstrual Health." Introduced on May 10, 2023, this proposal has been referred to the Social Affairs Committee of the French National Assembly for examination. In its current version, the proposal notably provides that a doctor or midwife who observes that a woman is suffering from dysmenorrhea will have the authority to issue a medical leave prescription for thirteen days, valid for one year, allowing that woman to interrupt work for a duration not exceeding two days per month.
